Welcome to picpins. Please read these Terms carefully before using our services. By using picpins, you agree to be bound by these Terms.
These Terms of Service ("Terms") govern the relationship between Channarong Wuthisan, 189/6 Moo 5 Baan Non Sombun, Na Kwang, Udon Thani 41000, Thailand ("we", "us", "picpins") and you ("you", "user") in connection with picpins.com and any related services, apps, and software (collectively, the "Service").
picpins is a web application for creating interactive images with markers, tooltips, and embed functionality. The Service is offered in the following plans:
We may modify the features of any plan at any time. Material changes will be announced by email with reasonable advance notice.
To use the Service you must create an account. You agree to provide accurate, current information. You are solely responsible for the security of your credentials and all activity that occurs under your account.
You must be at least 18 years old or the minimum age required to consent to use online services in your jurisdiction.
Paid plans are billed in advance. Charges appear on your statement as PICPINS. Subscriptions renew automatically for the chosen billing period unless canceled before renewal.
Fees are non-refundable except where required by applicable law. You may cancel your subscription at any time from your account; access continues until the end of the current billing period.
You retain all rights in content you upload or create using the Service ("Your Content"). You grant us only the rights necessary to operate the Service (storing, displaying, and making content available to recipients you authorize).
You represent and warrant that Your Content:
You will indemnify and hold us harmless against any third-party claim arising out of Your Content.
You may not use the Service to:
We may remove content without prior notice and suspend or terminate accounts for violations.
You may delete your account at any time. We may suspend or terminate your account if you breach these Terms or if continued provision of the Service to you is not feasible for legal or security reasons. Termination for cause does not entitle you to a refund.
We strive for high availability but do not guarantee uninterrupted access. Maintenance, technical issues, or events of force majeure do not give rise to damages claims.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for any indirect, consequential, special, or incidental damages, lost profits, lost data, or business interruption.
These limitations do not apply to liability for willful misconduct, gross negligence, or where a limitation is unenforceable under mandatory applicable law.
These Terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict of laws principles. The courts of Bangkok, Thailand have exclusive jurisdiction over any dispute arising out of these Terms.
Mandatory consumer protection laws of the user's country of residence remain unaffected to the extent they apply.
We may update these Terms. Material changes will be announced by email or in the Service. Your continued use after changes take effect constitutes acceptance.
If any provision is held unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and us regarding the Service.
